{"id":59683,"date":"2024-04-23T16:02:25","date_gmt":"2024-04-23T14:02:25","guid":{"rendered":"https:\/\/elitepole.dk\/?page_id=59683"},"modified":"2026-03-17T14:29:29","modified_gmt":"2026-03-17T13:29:29","slug":"medlemsbetingelser","status":"publish","type":"page","link":"https:\/\/elitepole.dk\/en\/om-os\/medlemsbetingelser\/","title":{"rendered":"Membership terms &amp; conditions"},"content":{"rendered":"<div id=\"modal-ready\">\n<h2 class=\"wp-block-heading has-text-align-center\"><strong>General terms &amp; conditions<\/strong><\/h2>\n\n\n\n<p class=\"has-text-align-center\">(membership terms  &amp; conditions below)<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>VAT \/ EU regulation:<\/strong><br>25% VAT applies to all prices for members <strong>aged 30+<\/strong> in accordance with EU and Danish legislation.<\/li>\n<\/ul>\n\n\n\n<p><strong>\u00a71 Cancelation<\/strong><br>If you wish to cancel a booking, this must be done min. 4 hours before the start of the class. After this deadline, cancellation cost the same as a registered class that is not attended: costs 1 clip with clip card \/ with membership DKK 49 (30+ INCL. VAT: 61,25 DKK) \/ with trial class it costs the trial class.<\/p>\n\n\n\n<p><strong>\u00a72 Price changes<\/strong><br>ElitePole reserves the right to make price changes. These will be notified by posting in the center and via e-mail (to members who have provided an e-mail address) no later than 30 days before the price changes take effect.<\/p>\n\n\n\n<p><strong>\u00a73 Availability<\/strong><br>ElitePole cannot guarantee available spots on the classes, as the classes are filled on a \"first come, first served\" basis.<\/p>\n\n\n\n<p><strong>\u00a74 Valuables<\/strong><br>Valuables must be brought into the classroom itself, as ElitePole does not guarantee loss due to theft or property damage.<\/p>\n\n\n\n<p class=\"translation-block\"><strong>\u00a75 Responsibility<\/strong><br>All training is done at your own risk. As a member of ElitePole, you are responsible for being in a state of health that allows participation. ElitePole does not take responsibility for personal injuries as a result of an accident in the center. Furthermore, Danish tort law is followed in this area.<\/p>\n\n\n\n<p><strong>\u00a76 The number of classes<\/strong><br>ElitePole has the right to continually change the number of classes.<\/p>\n\n\n\n<p><strong>\u00a77 Right of cancelation<\/strong><br>When purchasing over the Internet, you generally have a 14-day right of cancelation. If, however, you haven't used your membership (booked classes) and you haven't choose a start date that is within 14 days, the right of cancellation is waived at the start date.<\/p>\n\n\n\n<p><strong>\u00a78 Binding &amp; notice af termination<\/strong><br>Monthly memberships have a binding period of 4 months from the date of registration and can not be terminated during the binding period.<br>Once the binding period has expired, a notice period of the current month + 1 additional calendar month applies, during which payment for the membership must continue before the termination can take effect. This means that the membership always runs for a minimum of 5 months in total from the date of registration and will continue thereafter until it is actively terminated.<br><\/p>\n\n\n\n<h2 class=\"wp-block-heading has-text-align-center\"><strong>Membership terms &amp; conditions<\/strong><\/h2>\n\n\n\n<p><strong>\u00a7 1. The membership<\/strong><br>The membership is an agreement between the member and ElitePole ApS, cvr.number 37840130 (from now ElitePole).<\/p>\n\n\n\n<p>A membership is personal and cannot be used by anyone other than the member. A membership is personal and may not be used by anyone other than the member. It is not permitted to bring guests, partners, children, or any non-members into the studio \u2013 whether for classes, Self Practice, or any other type of training. Everyone present in the studio room must personally be registered for the class through our app. Violation of this rule is considered a material breach of the membership terms.<\/p>\n\n\n\n<p class=\"translation-block\">Changes in personal data such as name, address, e-mail, telephone number, card information, etc., must be be updated in the app by the member immediately. The membership gives access to train the number of monthly classes - and with the max. number of class reservations at a time associated with that membership. All memberships are ongoing memberships and thus bound by the notice period in \u00a7 9.<\/p>\n\n\n\n<p><strong>\u00a7 2. Changes<\/strong><br>ElitePole reserves the right to make changes to the classes and the opening hours without notice. Changes to the terms and conditions can enter into force 2 weeks after they have been announced on ElitePole's website at the earliest.<\/p>\n\n\n\n<p class=\"translation-block\"><strong>\u00a7 3. Duration<\/strong><br>A membership is always ongoing and continues until it is terminated in accordance with \u00a7 9.<\/p>\n\n\n\n<p><strong>\u00a7 4. Cancelation of classes \/ signing up to classes \/ check in to classes<\/strong><br>Cancelation of classes \/ signing up to classes must always be done via the app \/ online login. Cancelation of classes must take place at least 4 hours before the start time of the class. After the deadline a cancelation cost the same as a no-show fee: The member will be charged a fee of 49 DKK (30+ INCL. VAT: 61,25 DKK) for every class that is not cancelled in time \/ the member does not attend and participates in the class \/ the member does not check in to the class in time.<\/p>\n\n\n\n<p>Check in to classes must take place before the start time of the class on the check in computer in the studio. If this does not happen, a fee of 49 DKK per. class will be charged. It is the member's own responsibility to check in correctly and on time. ElitePole is not responsible for the correct check in of members.<\/p>\n\n\n\n<p>To participate in classes the member must sign up to the class online \/ via the app. If the member is participating in classes without being signed up to the class online \/ via the app the member will be charged a 200 DKK fine pr. class \/ pr. hour. This applies to both regular classes and Self practice time.<\/p>\n\n\n\n<p class=\"translation-block\">If the member checks into a class without participating in the class, ElitePole is entitled to charge the member a fee of 100 DKK per. class the member has blocked a place in without participating.\nAll fees will be charged along with the membership for the upcoming payment period.<\/p>\n\n\n\n<p><strong>\u00a7 5. Payment<\/strong><br>When signing up to a membership, the agreement is registered with NETS, and payment is made immediately for the period from the start date to the first payment via NETS. Thereafter, the monthly payment is automatically deducted from the member's payment card at the beginning of each calendar month.<\/p>\n\n\n\n<p><strong>\u00a7 6. Late payment<\/strong><br>If the recurring payment is not made on the agreed due date, a reminder will be sent in accordance with applicable legislation. A reminder fee of DKK 100 per reminder letter may be charged, and a maximum of three reminders will be sent with a minimum interval of 10 days between each reminder, should payment continue to be outstanding.<\/p>\n\n\n\n<p>If payment is not made within the specified deadline, this shall constitute a material breach of the membership agreement. ElitePole shall thereafter be entitled, without further notice, to terminate the membership with immediate effect. The membership will be suspended, and the member will be excluded from all forms of training at ElitePole until the full outstanding amount has been paid. The suspension period will not be credited or extended.<\/p>\n\n\n\n<p>In the event of breach, ElitePole is entitled to calculate and claim payment of all outstanding amounts as well as payment of the full remaining binding period, including any notice period, whereby the total amount shall fall due for immediate payment in accordance with the terms of the membership agreement. ElitePole further reserves the right to transfer the claim to external debt collection should payment continue to be outstanding. Upon transfer to debt collection, the member will be liable for additional costs in accordance with applicable regulations.<\/p>\n\n\n\n<p><strong>\u00a7 7. Price changes<\/strong><br>Price changes are announced on the website no later than 2 weeks before the price changes take effect. The member is responsible for keeping up to date. If the member subsequently does not wish to maintain his membership because of the price changes, the member is entitled to terminate his membership in accordance with the procedure in \u00a79.<\/p>\n\n\n\n<p><strong>\u00a7 8. Break periods<\/strong><br>The membership can be on a break for a minimum of 1 month, only for whole months and a maximum of 6 months. If the break period is to take effect on the upcoming first of the month, the break period must be stated to ElitePole no later than the 20th of the month. The start - and the end date of the break period must be stated to ElitePole by email. For each break period, a fee is paid at ElitePole's applicable rates. It is not possible to put a membership on break during a binding period.<\/p>\n\n\n\n<p><strong>\u00a7 9. Termination of membership<\/strong><br>A membership can be terminated at any time after any binding period has ended with a notice of current calendar month + 1 calendar month, where the member must pay for the membership before the cancellation takes effect.<\/p>\n\n\n\n<p>If the member is on pause at the time the membership is terminated, the pause period will be cancelled as of the date the termination is received, and membership fees will be charged until the termination takes effect in accordance with the applicable notice period. It is therefore not possible to remain on pause during the final payment period (current month plus one additional month) prior to the effective termination date.<\/p>\n\n\n\n<p>Termination of membership may be made via the app in accordance with the applicable rules regarding binding period and notice of termination. It is the member\u2019s own responsibility to ensure that the termination is correctly registered in the system.<\/p>\n\n\n\n<p>Requests for pausing (freeze) can only be made in writing by e-mail to ElitePole in accordance with the above conditions. The request must be sent from the e-mail address associated with the membership, or clearly state the e-mail address under which the membership is registered.<\/p>\n\n\n\n<p>In the event of any doubt as to whether a membership has been terminated or paused, the member bears the burden of proving that the termination or pause was carried out in accordance with the applicable procedure. A membership shall only be considered terminated or paused when this is reflected in the system or has been confirmed in writing by ElitePole.<\/p>\n\n\n\n<p>Termination does not release the member from payment of any outstanding amounts or other payment obligations under the membership agreement. If payment is outstanding at the time of termination, this shall be treated as a breach of contract in accordance with \u00a7 6.<\/p>\n\n\n\n<p><strong>\u00a7 10. Minor members<\/strong><br>If a person is under 18 years of age, membership can only be obtained if a guardian signs a membership for the person at the guardian's expense and responsibility. A guardian must thus sign the membership conditions in the studio before the person can use the membership and participate in training.<\/p>\n\n\n\n<p><strong>\u00a7 11. Health condition and personal injury<\/strong><br>All training is at your own risk. A member is responsible for being in a state of health that allows participation in activities at ElitePole. ElitePole also does not take responsibility for personal injury to a member because of accidents, other visitors' actions, or defective actions and\/or equipment fails.<\/p>\n\n\n\n<p><strong>\u00a7 12. Values<\/strong><br>ElitePole bears no responsibility for loss due to theft or damage to property. It is recommended that valuables will not be left unwatched but brought with you for training.<\/p>\n\n\n\n<p><strong>\u00a7 13. House rules<\/strong><br>The house rules must always be followed as well as instructions given by ElitePole's staff. The house rules can be found at www.elitepole.dk. <a target=\"_blank\" rel=\"noreferrer noopener\" href=\"https:\/\/elitepole.dk\/en\/\">www.elitepole.dk<\/a>.<\/p>\n\n\n\n<p><strong>\u00a7 14. Exclusion of member<\/strong><br>ElitePole may, without giving any reason, terminate any membership agreement with immediate effect. In that case, all unused prepayments will be refunded. In the event of a material breach of the membership conditions or the rules of order, such as or lending of membership cards to other persons, however, there is no repayment due to the termination of the membership.<\/p>\n\n\n\n<p><strong>\u00a7 15. Change of membership conditions<\/strong><br>ElitePole may change the membership conditions with a notice of 2 weeks. In the event of significant changes to the membership terms, this will be announced on ElitePole's website. If the member does not wish to maintain his membership because of the changes to the terms, the member is entitled to terminate the membership in accordance with the procedure in \u00a7 9. ElitePole has the right to make usual changes to rules, class activities, premises, equipment, and opening hours without notice.<\/p>\n\n\n\n<p class=\"translation-block\"><strong>\u00a7 16. Change of membership type<\/strong><br>Members may downgrade their membership type after the end of the binding period by paying a fee of DKK 100 (30+ INCL. VAT: 125 DKK) for changing membership type.\nIf a member wishes to upgrade their membership, this can be done at any time and free of charge.\nAny discounts or promotional offers cannot be applied when changing membership type.<\/p>\n\n\n\n<p class=\"translation-block\"><strong>Membership upgrade during campaign period<\/strong><br>Members may upgrade to a higher membership at any time. If the upgrade takes place during a campaign or introductory period, the price difference between the memberships will be charged for the remaining part of the campaign period. After the campaign period, the new membership will automatically continue at the regular price. The binding period remains unchanged from the original signup date.<\/p>\n\n\n\n<p><strong>\u00a7 17. Right of cancelation<\/strong><br>When purchasing over the internet, you generally have a 14-day right of cancelation if the membership has not been used. However, if you choose a start date that is within 14 days, the right of cancelation at the start date will lapse. The right of cancelation also lapses if the member has booked a class or participated in a class.<\/p>\n\n\n\n<p><strong>\u00a7 18. Duration \/ Membership<\/strong><br>A membership is a recurring payment that continues until it is terminated by one of the parties in accordance with \u00a79.<\/p>\n\n\n\n<p><strong>\u00a7 19. Criteria for subscription<\/strong><br>Before a debit via the payment card can occur, card information must match Nets' card database. The payment card must be active, and it must be possible to complete a transaction on the subscription amount. The payment card used for subscription withdrawals must be able to make transactions via the Internet. <br>It is at all times a requirement that a valid payment card, meeting the above criteria, is linked to the monthly membership until and including the last day the membership is active.<\/p>\n\n\n\n<p class=\"translation-block\"><strong>\u00a7 20. Update payment card information<\/strong><br>Card details can be updated by logging into the online booking system and selecting \u201cProfile\u201d \u2013 \u201cRegister new payment card.\u201d The customer is at all times responsible for ensuring that the card details are correct. If this is not complied with, ElitePole may, without prior notice, deactivate or terminate the membership in accordance with the procedure for non-payment, \u00a7 6.<\/p>\n\n\n\n<p class=\"has-text-align-left\"><strong>\u00a7 21.
